Last updated: 4 November 2026
1. Who is selling
Alexis Zueras, sole trader, trading under the business name AZ Analytics. SIREN 978 031 847, SIRET 978 031 847 00012, 12 rue du Tisserand, 32330 Courrensan, France. VAT not applicable, article 293 B of the French General Tax Code.
2. Scope
These terms apply to any consulting, data analysis and dashboard creation service sold by AZ Analytics to a business client. They are not intended for consumers. They apply together with the accepted quotation, which sets out the content, price and timescales; in the event of a contradiction, the quotation prevails. The client acknowledges having accepted them by signing or accepting the quotation.
3. Services and prices
- Audit of your figures: €1,000, 2 working days. If the client continues with a dashboard within 30 days, 50% of the audit price is deducted from the dashboard price.
- Custom dashboard: from €3,500, depending on the number of sources and indicators, as set by the quotation.
- Monthly follow-up: from €500 per month.
- Additional day: €500 per day.
Prices are net: VAT not applicable, article 293 B of the French General Tax Code. The applicable price is the one in the accepted quotation.
4. How the work is carried out
The client provides the necessary access and information within the agreed timescales. The timescales stated in the quotation are indicative and run from the receipt of those items. Work is carried out remotely. On-site visits are possible subject to prior written agreement; actual travel costs are then recharged against receipts, and travel time within the Gers is not invoiced.
5. Payment
- Audit: 50% of the total price on order, the balance on delivery.
- Custom dashboard: 30% of the total price on order, the balance on delivery. For a dashboard over €5,000, the quotation provides for staged payment: 30% on order, 40% on delivery of the intermediate milestone defined in the quotation, 30% on final delivery.
- Monthly follow-up: invoiced at the beginning of the month.
- Invoices are payable by bank transfer within 30 days of the invoice date.
- No early payment discount is granted.
- Any late payment automatically incurs, from the day after the due date and without reminder, penalties calculated at three times the French statutory interest rate, together with a fixed recovery charge of €40 (articles L441-10 and D441-5 of the French Commercial Code).
6. Term and termination of the monthly follow-up
The monthly follow-up is entered into for an initial term of 3 months, then renews automatically month by month. Either party may end it in writing with one month's notice, once the initial term has elapsed. Any month started remains payable.
7. Cancellation or termination by the client
The client may end an assignment at any time, in writing. The client then pays:
- for the work carried out up to the date the notice is received, pro rata to the price;
- a termination fee equal to 30% of the price remaining to be invoiced, to compensate for the reserved period and the loss of earnings (article 1794 of the French Civil Code).
The deposit paid is set off against these amounts. If it exceeds them, the surplus is refunded to the client. No termination fee is due if the assignment ends because of a serious failure by AZ Analytics, recorded in writing.
8. Confidentiality and data
The information and data provided by the client remain confidential and are used only for the assignment. A non-disclosure agreement may be signed beforehand. Where the assignment involves processing personal data on the client's behalf, a processing agreement compliant with article 28 of the GDPR is signed beforehand. For data relating to this site, see the privacy policy.
9. Intellectual property
After payment in full, the client holds a licence to use the dashboard and the deliverables produced for them, unlimited in time, non-exclusive, and for internal use. AZ Analytics retains ownership of its methods, templates and generic tools. AZ Analytics may cite the assignment as a reference, unless the client refuses in writing.
10. Liability
AZ Analytics is bound by an obligation of means. Its liability is limited to the amount paid by the client for the service concerned, and excludes indirect damage (loss of business, data or revenue). This limit does not apply in the event of gross negligence or wilful misconduct. The client remains responsible for the decisions made on the basis of the figures delivered.
11. Force majeure
Neither party is liable for a delay or failure caused by an event of force majeure within the meaning of article 1218 of the French Civil Code.
12. Governing law and disputes
French law applies. In the event of a dispute, the parties first seek an amicable solution. Failing that, the competent French courts have sole jurisdiction.
13. Language of the contract
These terms are written in French. The English translation is provided for information only: in the event of any discrepancy between the two versions, the French version prevails.
